PayKu Payment Gateway Terms of Service

1. Introduction

   Welcome to PayKu Payment Gateway, integrated with BookandLink Hospitality Software! These Terms of Service ('Terms') govern your use of PayKu services through the BookandLink platform, so please read them carefully. By accessing or using PayKu Payment Gateway through BookandLink, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the service.

2. Definitions
   • PayKu Payment Gateway: Refers to the payment processing service provided by BookandLink.
   • BookandLink Hospitality Software: Refers to the property distribution platform provided by BookandLink.
   • Service: Refers to the integration of PayKu Payment Gateway with BookandLink Hospitality Software.
3. Use of Service

   Eligibility: You must be at least 18 years old and capable of forming a binding contract to use the Service.

   Account Registration: You may need to register for an account with BookandLink Hospitality Software to access PayKu Payment Gateway services.    • Violating any laws or regulations
   • Using the Service for any illegal or fraudulent purpose
   • Impersonating any person or entity, or falsely claiming an affiliation with any person or entity
   • Interfering with or disrupting the operation of the Service or its associated networks
4. Payment Processing
   4.1

   Transaction Processing: PayKu Payment Gateway facilitates the processing of payment transactions between buyers and sellers through BookandLink Hospitality Software. We do not guarantee the availability, accuracy, or timeliness of any transaction.

   4.2

   Fees: Fees may apply for certain transactions processed through PayKu Payment Gateway. You agree to pay all applicable fees and charges, which will be disclosed to you prior to completing a transaction.

   4.3

   Disputes: Disputes regarding transactions processed through PayKu Payment Gateway should be resolved directly between the parties involved. PayKu Payment Gateway is not responsible for resolving disputes between users.
5. Intelectual Property

   All content and materials available through the Service, including but not limited to text, graphics, logos, button icons, images, audio clips, and software, are the property of PayKu or its licensors and are protected by copyright, trademark, and other intellectual property laws.

6. Limitation of Liability

   To the fullest extent permitted by law, PayKu shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service.

   We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
